Terms of Service
These Terms govern your use of the social media management and content-creation service (the "Service") provided by Cloudorax UG (haftungsbeschränkt) ("we"). By using the Service you agree to these Terms; if you do not agree, do not use the Service.
1. Account and email verification
You must create an account with accurate, current information and are responsible for your password's security. Email verification is mandatory; access to app features may be restricted until your address is verified. Administrator accounts may additionally be required to enable two-factor authentication (2FA).
2. Acceptable use
You agree not to publish content that violates law or third-party rights or the terms of connected platforms; not to produce or distribute spam, deceptive, hateful, illegal or harmful content; and not to attempt unauthorised access, reverse engineering, scraping or interference with the Service infrastructure.
3. Abuse and rate-limiting policy
To keep the Service safe and available for everyone, we apply automated rate limits and abuse protections to sensitive actions. These limits may change without notice, and accounts may be suspended on detection of abuse:
- Authentication: login and registration attempts are limited per IP + email (brute-force / credential-stuffing protection).
- Password reset & email verification: signed-link sends and resends are capped (default: 6 per minute).
- Two-factor: 2FA code attempts are throttled to prevent guessing.
- Publishing & API: post publishing and programmatic API calls are queued and limited to respect provider quotas and fair use.
- Data export: only one export job may run at a time per user.
- General API access: abnormal traffic may be temporarily blocked or limited at the account level.
We reserve the right to suspend or terminate accounts that deliberately exceed these limits or where abuse or a security breach is suspected, without prior notice.
4. Content ownership and licence
You retain ownership of content you upload. You grant us a limited, worldwide, royalty-free licence to host, process and — on your instruction — publish it to connected platforms, solely to provide the Service. You are responsible for your content's legality and for respecting third-party rights.
5. Third-party platforms
The Service relies on the APIs of the platforms you connect (Facebook, Instagram, X, LinkedIn, TikTok, YouTube, Pinterest, etc.). Those platforms' own terms apply, and we are not liable for delays or failures caused by their API changes, outages or account restrictions.
6. Subscriptions, fees and cancellation
Paid plans are billed per the chosen billing cycle. You may cancel at any time; the cancellation takes effect at the end of the current period. Your statutory consumer rights are unaffected.
7. Limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the amount you paid in the 12 months preceding the claim.
8. Termination
We may suspend or terminate your account if you breach these Terms. You may delete your account at any time from Settings → Privacy; the deletion process is described in the Privacy Policy.
9. Governing law and changes
These Terms are governed by the laws of Germany, whose courts have jurisdiction over disputes. We may update these Terms from time to time and will signal material changes by updating the effective date.
